Welcome to BrightNex Marketing (“Company”, “we”, “our”, “us”).
By using our services, you (“Client”, “Customer”, “You”) agree to the following Terms & Conditions.


1. Service Description

BrightNex Marketing provides the following services:

  • Pay-Per-Lead (PPL)

  • Pay-Per-Qualified Lead (PPQL)

  • Pay-Per-Appointment

  • Pay-Per-Sale / Commission-Based Lead Generation

  • Paid Ads Management (Meta, Google, LinkedIn)

  • Landing Page Design

  • Content & Creative Development

  • Lead Delivery & Analytics

All services are delivered based on the selected monthly plan + pay-per-lead billing.


2. Lead Definition

A lead is counted when:

  • User submits form / WhatsApp message / call / enquiry

  • Details are delivered to the client

  • Lead meets the agreed basic criteria

Leads are considered valid once delivered through:
✔ Email
✔ WhatsApp
✔ Dashboard
✔ CRM Integration


3. Payment Terms

  • Monthly service fees must be paid in advance.

  • Pay-per-lead charges are billed weekly or bi-weekly.

  • Work begins only after successful payment confirmation.

  • In the case of late payment, services may be paused.


4. No Guarantee Clause

We do not guarantee:

  • Sales

  • Appointments

  • Revenue

  • Long-term business outcomes

We guarantee only:
✔ Delivery of leads as per your plan
✔ Ads management & optimization
✔ Transparent reporting


5. Advertiser Account & Budget

Depending on the package:

  • Ads may run on our ad account or client’s ad account.

  • Ad budget is separate from service fees.

  • If the campaign runs on our ad account, we reserve the right to control ad settings.


6. Client Responsibilities

Client agrees to:

  • Provide accurate business information

  • Respond to leads on time

  • Handle sales conversion

  • Maintain ethical communication

We are not responsible for missed leads due to client delay or improper follow-up.


7. Lead Quality & Verification

Invalid leads include:

  • Duplicate leads

  • Fake numbers

  • Spam submissions

  • Outside target location (if not agreed)

Invalid leads are replaced only if:
✔ Client provides proof within 24 hours
✔ Lead meets invalid criteria


8. Ownership & Intellectual Property

All:

  • Ad campaigns

  • Creative content

  • Landing pages

  • Funnels
    remain the property of BrightNex Marketing unless agreed otherwise.


9. Termination

Either party may terminate service with:

  • 7 days written notice

  • All pending dues must be settled before termination

No refunds will be issued for partial service usage.


10. Legal Jurisdiction

All disputes are subject to the jurisdiction of Tirunelveli, Tamil Nadu, India.

REFUND POLICY

BrightNex Marketing follows a strict no-refund policy due to the nature of digital advertising and service-based work.


1. Non-Refundable Payments

The following are non-refundable:

  • Monthly service charges

  • Setup fees

  • Pay-per-lead payments

  • Creative & ad management fees

  • Landing page design fees


2. Ads Budget Refund

If ads are run using:

  • Client’s ad account → Refund is handled by the platform (Meta/Google) as per their policy.

  • BrightNex’s ad account → No refund is possible after ads are launched.


3. Lead Replacement Policy

We offer lead replacement only, not refund.

Valid for replacement:

  • Fake numbers

  • Wrong numbers

  • Duplicate submissions

Client must report invalid leads within 24 hours of delivery.


4. Service Cancellation

If you cancel the service:

  • No refund for remaining days of the month

  • All unpaid dues must be cleared

  • Pay-per-lead settlement must be completed

3. Pay-Per-Lead Billing After Cancellation

If leads were already generated but not paid for:

  • Pay-per-lead invoices must be cleared

  • Leads generated until cancellation date are fully billable


4. Ad Campaigns

If campaigns run on BrightNex’s ad account:

  • We will pause ads within 24 hours

  • No refunds for running ads already spent

If campaigns run on the client’s ad account:

  • Client must pause ads from their end


5. Landing Pages & Creatives

All created landing pages, ad copies, and creatives remain BrightNex Marketing’s property unless otherwise contracted.

After receiving onboarding details:

  • Meta Ads Setup: 24–48 hours

  • Google Ads Setup: 48–72 hours

  • LinkedIn Ads Setup: 72 hours

  • Landing Page Setup: 2–3 days


4. Response Time

  • Email/WhatsApp Support Response: 2–6 hours

  • Lead Issue or Replacement Review: 24 hours

  • Technical Fix: 24–48 hours


5. Quality of Service

We ensure:

  • Verified data collection

  • Daily campaign optimization

  • Lead delivery accuracy

  • Reporting transparency

But we cannot guarantee:

  • Results beyond lead delivery

  • Sales conversions

  • Appointment attendance

  • Long-term outcomes
