By engaging with BrightNex Marketing’s services, you agree to the following terms and conditions:

1. Services Offered

  • Lead Generation (Pay-Per-Lead Model): Clients are billed only for qualified leads on a weekly invoice basis. No advance payment is required.
  • Sales Generation (Pay-Per-Sale Model): Clients are billed for qualified leads plus a commission on successfully closed deals. Payments follow a weekly invoice cycle. No advance payment is required.
  • 360° Digital Marketing Solutions: Requires a 50% advance payment, with the balance due upon project delivery.
  • Website Design and Development: Requires a 50% advance payment, with the balance due upon project delivery.

2. Lead Qualification & Replacement Policy

  • Only leads meeting the agreed qualification criteria will be billed.
  • Any invalid or non-qualified lead reported within 48 hours of delivery will be replaced free of charge.
  • No refunds will be issued for leads, only replacements as per the replacement policy.

3. Payment Terms

  • Pay-Per-Lead & Pay-Per-Sale: Weekly invoices must be cleared within 3 business days of receipt.
  • Project-based Services: Remaining 50% payment is due before final delivery/launch.

4. Client Responsibilities

  • Provide accurate and complete business requirements, product/service details, and target audience information.
  • Respond promptly to communication for smooth service execution.

5. Intellectual Property

  • All creative assets, designs, and marketing materials remain the property of BrightNex Marketing until full payment is received.

6. Limitation of Liability

  • BrightNex Marketing is not liable for business losses, sales fluctuations, or revenue changes resulting from marketing campaigns.
  • Services are provided on a best-effort basis with no guarantee of specific business outcomes.

7. Governing Law

  • These terms are governed by the laws of Tamil Nadu, India, and any disputes will be handled in the jurisdiction of Tirunelveli courts.

2. Privacy Policy

At BrightNex Marketing, we respect your privacy and are committed to protecting your personal information.

  • Contact details (name, email, phone number, address)
  • Business information (company name, products/services, target audience)
  • Payment details for billing purposes

2. How We Use Your Information

  • To provide and manage services
  • To send invoices, updates, and service-related communication
  • To improve marketing campaigns and customer experience

3. Data Protection

  • All client information is stored securely and is accessible only to authorized personnel.
  • We do not sell, trade, or share your personal information with third parties without consent, except as required by law.

5. Third-Party Links

3. Refund & Lead Replacement Policy

1. Refund Policy

  • Lead Generation & Sales Generation: No refunds are issued for leads provided.
  • 360° Digital Marketing Solutions & Website Design/Development: Refunds are not provided for work already initiated or completed.

2. Lead Replacement Policy

  • Invalid or non-qualified leads must be reported within 48 hours of delivery.
  • Replacement will be provided within 3–5 business days after verification.
  • Lead qualification criteria must be agreed upon in writing before the project starts.

3. Advance Payments

  • 360° Digital Marketing and Website Design/Development services require a 50% advance. This advance is non-refundable once work begins.
